Workplace Protection Membership Terms & Conditions

Ubuntu Labour Support (“ULS”) provides labour advisory and representation services to members. By joining, you agree to the following terms.

1.1 Scope of Membership

Membership provides:

  • Workplace advice and consultation

  • Assistance with disciplinary matters

  • CCMA / bargaining council guidance

  • Drafting of letters and disputes

  • Employer communication support

  • COIDA / UIF assistance

  • Collective worker representation

  • Early dispute prevention

Membership does not automatically include:

  • Magistrate or High Court representation

  • Travel-based appearances outside local area

  • External legal counsel fees

  • Court litigation costs

  • Expert witness fees

These services may require separate written agreement.


1.2 Membership Fee

  • Membership is billed monthly

  • Non-payment may suspend services

  • Membership is not insurance

  • Membership is advisory and representational


1.3 No Guarantee Clause

ULS provides professional labour support, but:

  • Outcomes cannot be guaranteed

  • Decisions are made by CCMA, courts, or employers

  • Advice is guidance, not a ruling


1.4 Termination of Membership

ULS may terminate membership if:

  • False information is provided

  • Abuse or harassment occurs

  • Fraudulent claims are made

  • Membership fees remain unpaid

Members may cancel with written notice.


2. Representation Mandate Policy

Purpose: Defines how ULS legally represents workers.

ULS acts only when:

  • A signed mandate is received

  • The employee voluntarily consents

  • Scope of representation is clear

ULS may represent:

  • Individuals

  • Groups

  • Departments

  • Collective worker bodies

ULS does not act without written authority.

Employers may verify mandates in a POPIA-compliant manner.


3. Confidentiality & POPIA Policy

Purpose: Protect personal information.

ULS commits to:

  • Secure storage of worker records

  • Limited sharing only when required

  • Written consent before disclosure

  • POPIA compliance at all times

Personal information may be shared with:

  • Employers (for representation)

  • CCMA / bargaining councils

  • Department of Labour

  • Courts or sheriffs

Information is never sold or used for marketing.

Employees may request access to their records.


4. Liability Disclaimer

ULS is an independent labour support consultancy.

ULS is not a law firm.

ULS provides:

  • Labour advisory services

  • Representation support

  • Documentation assistance

ULS is not responsible for:

  • Employer decisions

  • Commissioner rulings

  • Court outcomes

  • Witness refusal

  • Delays outside our control

All actions are taken in good faith.


5. Case Management Policy

Every case follows a structured process:

  1. Intake and mandate verification

  2. Evidence collection

  3. Employer communication

  4. Internal review

  5. Escalation decision

  6. Representation

  7. Closure and reporting

ULS maintains:

  • Written records

  • Communication logs

  • Evidence files

  • Timeline tracking

Cases are confidential.


6. Dispute Escalation Policy

ULS escalates disputes in this order:

  1. Internal employer engagement

  2. Written demand

  3. CCMA / bargaining council referral

  4. Department of Labour complaint

  5. Sheriff enforcement

  6. Court escalation (if necessary)

Escalation is lawful and documented.


7. Payment & Financial Policy

Membership covers advisory services.

Additional services may include:

  • Travel costs

  • Court appearances

  • External legal fees

  • Document certification

  • Sheriff costs

These require written approval before proceeding.

ULS never charges hidden fees.


8. Workplace Injury (COIDA/WCA) Support Policy

ULS assists injured workers with:

  • Claim documentation

  • Employer compliance

  • Department of Labour communication

  • Payment follow-up

  • Medical record coordination

ULS does not replace medical professionals.


9. Professional Conduct Policy

ULS commits to:

  • Respectful communication

  • Lawful engagement

  • No intimidation tactics

  • Neutral professionalism

  • Ethical representation

Members must also behave respectfully.

Abusive conduct may terminate service.


10. Media & Public Communication Policy

ULS may share case information:

  • Only with client consent

  • Without identifying details unless authorized

  • For awareness and advocacy

ULS avoids defamation and protects client privacy.
